Terms of Service

Agreement

These Terms of Service (“Terms”) govern your use of the website design and development services provided by 96 Hour Sites, operated by Richard (“we”, “us”, or “our”). By enquiring about, commissioning, or paying for any service, you agree to these Terms in full.

These Terms should be read alongside our Privacy Policy.

Services

96 Hour Sites offers the following services:

  • 96-Hour Custom Website. A fully custom-coded website designed, built, and delivered to a staging URL within 96 hours of project kickoff, which begins once we have received your content, brief, and payment (or agreed payment schedule).
  • Advanced Custom Website. A more complex build including advanced functionality, integrations, and extended support. Timelines are agreed individually.
  • Website Performance Audit. A professional review of your existing website covering speed, SEO, UX, and conversion, delivered as a written report with a Loom video walkthrough.

All services are described at the time of enquiry and/or in a written project scope agreed between both parties. We reserve the right to decline any project at our discretion.

Free First Concept

We offer a free first concept design and staging deployment with no obligation. This concept is a design direction, not a finished website. You are under no obligation to proceed, and no payment is required to receive the free concept.

If you choose not to proceed after receiving the free concept, you retain no rights to the design work produced. All concepts that are not purchased remain the intellectual property of 96 Hour Sites.

Pricing & Payment

Current pricing is as follows:

Website Performance Audit$300 one-time (or 3 × $129)

The $300 audit fee is credited toward your build cost if you proceed with a new website.

96-Hour Custom Website$1,950 one-time (or $249/month × 12)

One-time payment saves 35% vs. the monthly subscription.

Advanced Custom WebsiteFrom $4,950 (or $549/month × 12)

Scope and pricing confirmed in writing before work begins.

Payment is due as agreed in writing. For lump-sum projects, payment is required before the build begins. For subscription plans, the first payment is due before kickoff and subsequent payments are due monthly.

All prices are in USD unless otherwise stated. Prices are subject to change; the price agreed at the time of your order will not change for that order.

Delivery & Timeline

The “96 hours” delivery clock starts from project kickoff, defined as the point at which we have received all of the following:

  • Confirmed payment (or agreed payment arrangement)
  • Your completed project brief or content
  • Any brand assets, images, or credentials required

Delivery is to a staging URL. We will notify you when the site is live on staging and begin the revision process. Final deployment to your live domain follows once revisions are signed off.

While we make every reasonable effort to meet the 96-hour target, delays caused by incomplete briefs, missing content, or factors outside our control do not constitute a breach of these Terms.

Revisions

The 96-Hour Custom Website includes 3 rounds of revisions. A “round” is a consolidated set of changes submitted in a single request. Revisions must be submitted within 14 days of staging delivery.

The Advanced Custom Website includes unlimited revisions within the agreed scope.

Revisions that materially change the agreed scope (adding new pages, sections, or functionality not in the original brief) are treated as new work and quoted separately.

Intellectual Property

Upon full payment, you own the delivered website and all custom design and code created for your project. We retain the right to display the completed work in our portfolio and case studies unless you request otherwise in writing.

We may use open-source libraries, third-party fonts, or licensed assets in your build. You are responsible for ensuring any content you supply (text, images, logos) does not infringe third-party intellectual property rights.

Work produced during the free concept stage that is not purchased remains our intellectual property.

Hosting & Domain

Domain registration and hosting costs are not included in the project price unless explicitly stated. We will advise on suitable options and assist with setup, but ongoing hosting fees are your responsibility.

If you use a hosting plan recommended by us, you retain full ownership of your account and can migrate at any time.

Refunds & Cancellations

Given the nature of custom design and development work, refunds are not available once project work has begun. If you cancel before kickoff (before we have started work), any payment will be refunded in full within 7 business days.

For subscription plans, you may cancel at any time. Cancellation stops future billing but does not entitle you to a refund of payments already made. The delivered work remains yours.

In the unlikely event we are unable to complete your project, we will refund any payment received in proportion to work not completed.

Limitation of Liability

To the fullest extent permitted by law, 96 Hour Sites is not liable for any indirect, incidental, or consequential damages arising from use of the delivered website or services, including but not limited to lost revenue, lost data, or business interruption.

Our total liability for any claim related to a project is limited to the amount paid for that project. We make no guarantees regarding specific business outcomes, search engine rankings, or conversion rates.

Warranties

We warrant that all work is original and does not knowingly infringe third-party intellectual property. We do not warrant that the website will be free from all bugs or compatible with every device and browser, but we will resolve any issues reported within 30 days of delivery at no additional charge.

Changes to These Terms

We may update these Terms at any time. The effective date at the top of this page reflects the latest revision. For active projects, the Terms in place at the time your project was confirmed apply.

Governing Law

These Terms are governed by applicable law. Any dispute shall be resolved by good-faith negotiation in the first instance. If you have a concern, contact us directly at richard@96hoursites.com and we will respond within 5 business days.
